Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Food Challenge Hub mobile application and website (together, the "Service"), operated by Food Challenge Hub Ltd ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who We Are

Food Challenge Hub is a directory and community platform for discovering, tracking, and discussing food-eating challenges hosted by independent, third-party restaurants and venues ("Venues"). We do not organise, run, host, or supervise any challenge ourselves.

2. Eligibility

You must be at least 13 years old to create an account. By using the Service, you confirm that you meet this requirement and that any information you provide during registration is accurate.

3. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Let us know immediately if you believe your account has been accessed without your permission.

4. Assumption of Risk — Food Challenges

Eating challenges carry genuine physical risk. Attempting to eat large quantities of food, spicy food, or food within a time limit can cause choking, aspiration, allergic reaction, vomiting, gastric injury, and — in rare cases — death.

Challenges listed on the Service are hosted, operated, and supervised (if at all) entirely by independent third-party Venues, not by us. We do not verify that a challenge is being run safely, that stated weights/times/ingredients are accurate, or that a Venue has appropriate food-safety, allergen, or emergency procedures in place.

You participate in any challenge entirely at your own risk. You should not attempt a challenge if you have any swallowing difficulty, relevant allergy, or medical condition, without first consulting a doctor — and you should always confirm allergen and ingredient information directly with the Venue before eating, since listings on the Service may be incomplete or out of date. Never attempt a challenge while under the influence of alcohol or drugs, or if you feel unwell.

To the fullest extent permitted by law, Food Challenge Hub Ltd accepts no liability for injury, illness, death, or other harm arising from your participation in any challenge, howsoever caused, including where a challenge listing was inaccurate, out of date, or submitted by another user or Venue in error.

5. User Content

You may submit challenge listings, results, photos, videos, tips, reviews, forum posts and replies, and other content ("User Content"). By submitting User Content, you agree to comply with our Community Guidelines, which form part of these Terms. You're solely responsible for the accuracy and legality of anything you submit. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute it within the Service (including to other users) for as long as it remains on the Service.

Do not submit content that is false, defamatory, infringes someone else's rights, or that you don't have permission to share (e.g. a photo or video you didn't take and don't have rights to).

Forum. The Community Forum lets you start discussion threads and reply to others. Some Forum sections are restricted to specific groups of users (for example, verified members, Premium subscribers, or venue accounts) — anything you post there is visible to everyone who meets that section's access requirement, not just you and the person you're replying to. Forum posts are published immediately and are not reviewed before appearing; see Section 7 for our right to remove content after the fact. Deleting a discussion thread also permanently deletes every reply within it, including replies from other users. Our Community Guidelines set out, in plain language, what is and isn't acceptable to post — they form part of these Terms.

You can report a specific piece of User Content (a challenge, a profile, a leaderboard result, a forum thread, or a forum reply) directly within the app, and you can block another user to stop seeing their content in your own feeds. We review reports and act on genuine violations; submitting a report doesn't guarantee a specific outcome, and we may decline to act on a report we don't consider to breach these Terms or our Community Guidelines.

6. Copyright Infringement Claims

User Content is uploaded by users of the Service, not created or vetted by us before it appears. We are not responsible for, and disclaim all liability arising from, any User Content that infringes a third party's copyright or other intellectual property rights. Responsibility for ensuring User Content doesn't infringe another party's rights rests solely with the user who submitted it.

If you believe content on the Service infringes your copyright, send a notice to our DMCA Designated Agent, registered with the U.S. Copyright Office (registration number DMCA-1079600):

Your notice should include: (1) a description of the copyrighted work you believe has been infringed; (2) the specific location of the content on the Service (e.g. a link or screenshot); (3) your contact details; and (4) a statement that you have a good-faith belief the use is unauthorised, and that the information you've provided is accurate. We will review valid notices and remove or disable access to infringing content, and may suspend or terminate the account of a user found to be a repeat infringer.

7. Reviews and Moderation

Challenge submissions, edits, and results go through a review process before appearing publicly, and may be rejected, corrected, or removed at our discretion — including after publication, if we later determine something was inaccurate, unsafe to leave listed, or in breach of these Terms.

Forum posts and replies are published immediately and are not reviewed in advance. Our moderators and admins may remove any thread or reply, lock a thread to new replies, and suspend or ban an account from the Forum or the Service entirely, at their discretion — including in response to a user report (see Section 5) or without one. We aim to act on reports of genuinely objectionable Forum content promptly.

8. Prohibited Conduct

Our Community Guidelines give fuller, plain-language examples of what belongs (and doesn't) in the Forum. We may suspend or terminate an account that breaches these Terms or our Community Guidelines, at our discretion, with or without notice.

9. Premium Subscriptions

Eaters and Venues may separately purchase an optional Premium subscription, unlocking additional features described in the app. Subscriptions are billed in advance on a recurring basis (monthly or yearly, as selected) and renew automatically until cancelled.

Subscription prices may change with notice; continued use after a price change constitutes acceptance of the new price for future renewals.

10. Third-Party Venues

Venues listed on the Service are independent businesses, not our employees, agents, or franchisees. We're not responsible for a Venue's food safety practices, hygiene standards, staff conduct, or whether they honour a listed challenge's stated reward. Any dispute with a Venue is between you and that Venue.

11. Intellectual Property

The Service, including its design, branding, and underlying software, is owned by Food Challenge Hub Ltd and protected by intellectual property law. Nothing in these Terms grants you rights to our trademarks or branding beyond what's needed to use the Service normally.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including as to accuracy, reliability, or fitness for a particular purpose. We don't warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

To the fullest extent permitted by law, Food Challenge Hub Ltd shall not be liable for any indirect, incidental, special, or consequential damages, or for any injury, illness, or death arising from participation in a challenge listed on the Service (see Section 4). Nothing in these Terms limits liability that cannot lawfully be limited, such as liability for death or personal injury caused by our own negligence.

14. Indemnification

You agree to indemnify and hold Food Challenge Hub Ltd harmless from any claim, loss, or damage (including reasonable legal fees) arising from your use of the Service, your User Content, or your breach of these Terms.

15. Termination

You may stop using the Service and delete your account at any time via the app. We may suspend or terminate your access if you breach these Terms.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continuing to use the Service after a change takes effect constitutes acceptance of the revised Terms.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except that we may seek injunctive or equivalent relief in any jurisdiction to protect our intellectual property or systems. If you're a consumer resident elsewhere, this doesn't remove any protection given to you by mandatory laws of your country of residence.

18. Additional Terms for Apple App Store Users

If you downloaded the app from Apple's App Store, this Section 18 also applies and takes precedence over any conflicting term elsewhere in these Terms, solely with respect to your use of the app on an Apple-branded device:

19. Additional Terms for Google Play Users

If you downloaded the app from Google Play, these Terms are between you and Food Challenge Hub Ltd only, not Google. Google is not a party to these Terms and has no obligation to provide maintenance, support, or warranty services for the app.
